S73 application for a revised scheme following change in contractor

 

Kings Leadership Academy

DPP previously achieved planning permission for the development of a Green Belt site into a new 6FE secondary school campus, comprising of a large two-storey teaching block together with access, landscaping, car parking and associated works in April 2021.

Following the granting of planning permission, DPP were instructed by Galliford Try to prepare, submit and manage a S73 application for a revised scheme for the Kings Leadership Academy. Galliford Try had been appointed by the DFE as the new contractor on the project and as a result, a number of amendments were required to the previously consented scheme. Whilst the majority of the proposal remained the same, the amendments sought as part of this application included a change in the type of access proposed (changing from bridge to culvert), change in the design and external materials used and an enhanced landscaping scheme.

DPP advised on planning strategy early in the process and held pre-application discussions with the LPA to agree that the amendments could be dealt with by way of a S73 application rather than a new full planning application.

DPP successfully dealt with consultee responses to guarantee the application could meet the desired timescales from the client. The scheme was heard at planning committee in April 2022 (10 weeks after submission) where it was recommended for approval by Officers and this was carried by Members.

DPP reviewed draft conditions and liaised with the LPA to remove the need for any pre-commencement conditions, as well as negotiating revised time triggers to ensure these fitted with the clients proposed program of works.
