Amendments to planning consent

DPP acted on behalf of Algeco (on behalf of the Defence Infrastructure Organisation (DIO) to secure a series of minor material (S.42) and non-material (NMV) amendments to two planning consents which permitted the construction of two single-living accommodation blocks with associated car parking and landscaping as well as demolition of three existing blocks on-site at RAF Kinloss, Moray, Scotland.

DPP also acted on behalf of Algeco to discharge the series of planning conditions attached to both planning consents, in order to achieve a timely start on-site.

DPP also provided advice in relation to the prior notification of demolition (PNOD) process, as the demolition strategy progressed from that which was originally consented, meaning Algeco could progress with demolishing a building which was not originally proposed for demolition by way of permitted development rights which we discussed and agreed with the LPA in advance

Achievements

DPP successfully discharged the required planning conditions on both consents to allow a timely and lawful start on site in line with the client’s construction programme, and facilitated successful discussions with the LPA to ensure that any amendments required were secured formally through the planning process by way of a NMV or S.42 application. DPP acted accurately and efficiently to provide a reduced-risk and successful outcome for the client.

All planning conditions have now been discharged across both consents, and all amendments formally granted planning permission.
